Most people learn they are under federal investigation in one of three ways: agents appear at their door, a grand jury subpoena arrives, or a target letter lands in the mail. What you do in the days that follow can shape the entire case — often more than anything that happens later in court.<\/p>\n
FBI, DEA, IRS-CI, and HSI agents are trained interviewers, and they rarely knock before they already know the answers to their questions. You are not required to answer, and you should not — politely take the agent’s card and say your attorney will be in touch. Remember: making a false statement to a federal agent is a separate felony under 18 U.S.C. § 1001, even if you are never charged with the underlying offense.<\/p>\n
In a federal investigation you are a witness, a subject, or a target — and the difference matters enormously. Defense counsel can often learn your status from the U.S. Attorney’s Office and open a line of communication that protects you while the investigation is still forming.<\/p>\n
Do not delete emails, messages, or files — even innocently. Obstruction charges are frequently easier for the government to prove than the underlying offense, and they destroy your credibility and your negotiating position.<\/p>\n
Conversations with friends, business partners, or co-workers are not privileged, and in conspiracy investigations the person you confide in may already be cooperating. Speak about the case only with your attorney.<\/p>\n
The most valuable phase of a federal case is often the one before charges are filed. Experienced federal counsel can present exculpatory evidence, challenge the government’s theory, negotiate the scope of any charges, and in some cases secure a declination — a decision not to prosecute at all.<\/p>\n
